A signed waiver is necessary to be completed by all who wish to jump at Ozone. If you are under 18 the waiver must be completed by your parent, legal guardian or consenting responsible adult. As Ozone can get busy, particularly at weekends, to avoid unnecessary disappointment, we recommended you book online ahead of arrival. Please ensure you turn up 20 minutes ahead of your pre-booked time slot.
Ozone Trampoline socks MUST be worn at all times when on the trampolines, we do not except other Trampoline Parks socks.
Definitions
· (“Ozone”) : The operating brand of SKiS Entertainment SA (“SKiS”), a registered company in Luxembourg with registration number B227944.
· (“Activity”) : Any organised, supervised or pursuit in which a person is active or any other products set out in a booking form. Typically at Ozone this is a jumping session, a Ninja obstacle, a birthday or other type of party, a fitness session, a team building event, a climbing course/challenge and any other variant of these things as pertaining to the items provided for fun and entertainment while visiting the park.
· (“Waiver”) : A form either electronically or via paper format, that requires to be completed by every participant within the parc. It sets out further the risks, liabilities and awareness of the activities within the parc.
OZONE BOOKING TERMS & CONDITIONS
These Terms and Conditions apply to the booking of any “Activity” at Ozone Trampoline and Ninja parc based in Luxembourg, herein known as (“Ozone”) . These Terms and Conditions contain important information regarding your participation and all members of your party and accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Booking Terms and Conditions.
GENERAL
No variation to these Booking Terms and Conditions shall be enforceable unless agreed in writing by “SKiS”. Any typographical, clerical or other error or omission in any booking confirmation or other documentation issued by ”Ozone” (including any electronic documentation) shall be subject to correction without any liability on the part of “SKiS”, who reserves the right to make changes to the “Activities”whether to conform with any applicable safety or other statutory requirements or for any reason and without notice.
Any person using the “Ozone” facilities must complete, or have a “Waiver” completed on their behalf. Those participants under 18, or any participant without the capability to complete their own waiver, must ensure a legal guardian has completed a waiver on their behalf.
Any persons using the trampoline parc MUST be 3 years of age or over. For those under 5 participating in a Session MUST in all cases must be accompanied by a consenting responsible adult.
Any person causing wilful damage to the facilities, fixtures or fittings of Ozone will be liable to pay for the rectification of any damage caused. This includes any damage caused by misuse of equipment and/or failure to comply to supplied guidance. If damage is caused by a member of a party or group booking, the hirer will be liable to pay for the rectification of any damage caused by anyone attending the party or group booking.
Ozone does not accept responsibility for the loss of property or theft arising from the use of facilities. Money or valuables should, therefore, not be left unattended. This includes vehicles in surrounding car parks or parked on neighbouring roads. Valuables can be deposited in provided locker facilities. Vehicles and their contents are left at their owner’s risk.
Ozone reserve the right to refuse admission to anyone engaging in what is believed to be antisocial or unsafe behaviour, under the influence of drugs or alcohol. On the basis of health and safety Ozone reserves the right to refuse entry to late arrivals.
No refunds of compensation will be payable by Ozone in the event that any participant is not permitted to, refused permission or decides not to, undertake or complete the activities.
Ozone reserve the right to remove, change, swap or otherwise alter elements within the park at any time.
BOOKING CONFIRMATION
No booking shall be deemed to have been accepted unless in writing by Ozone (which shall include the Ozone email confirmation of booking).
These Booking Terms and Conditions incorporate our Privacy Policy, Risk Acknowledgement and Disclaimer (Waiver Form). All members of a party will be required to complete our waiver form, or have one completed on their behalf, before being allowed to undertake the Activities.
You must advise Ozone as soon as possible of any mistake in its booking confirmation. Ozone shall use its reasonable endeavours to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may be refused to undertake the Activities and no refunds or compensation will be payable in such circumstances.
Customers are advised to arrive at least 20 minutes prior to the jump time in off-peak hours, and up to 30 minutes during peak periods (weekends and school holidays) if there is no reservation. This allows time to check-in, follow any necessary procedures and be ready to start on their designated time. Please be advised it is the customers’ responsibility to arrive for their jump session in good time.
SAFETY
The Activities include all variations of Trampolines, climbing elements and challenge course and your participation is not without risk as serious misuse could be fatal. All participants must attend or have previously watched a safety briefing video online prior to every jumping session.
Ozone reserves the right to refuse entry to participants or to remove a participant from the premises should it be deemed necessary to do so. This includes a participant who does not comply with the safety rules and advice and the safety system, a participant whose behaviour is considered unsafe, or who is thought to be under the influence of alcohol or drugs. The decision of the Manager on duty will be final.
Upon entry to the park, participants will not be individually supervised by a court monitor in the Ozone facility. However, court monitors will be on hand to ensure the safety policy with each Activity is adhered to and to ensure both a safe and enjoyable experience for all.
A responsible adult must remain on site for any child 12 years of age or under using the parc facilities..
Supervising adults (whether participating or spectating) must sign the Ozone Waiver, stating that he or she will accept responsibility for the safety of him or herself and for supervision of children in his or her care.
All participants are required to wear Ozone Trampoline socks to increase grip and for hygiene reasons whilst in the park. Damaged or ill-fitting socks can cause damage and increase the risk of injury for any participant. In such cases the participant will be asked to buy socks with suitable grip.
All participants must be reasonably fit and healthy and are subject to the age and weight restrictions for each activity as stated at the time of booking. Participants confirm that the maximum permitted weight of any person shall not exceed 120kg and that they do not exceed this weight. Children aged 3 or 4 years old can enter the parc, if they are out of nappies, but must be accompanied by a paying adult at all times in the park (max 3 children per supervising adult). If you have any concerns, we advise that you visit a site at a time prior to your booking and speak to a member of the Ozone staff. Anyone who does not meet these requirements will not be allowed to undertake the Activities. It is your responsibility to ensure that all members of your group or party meet these requirements.
The Activities are physically demanding and require a degree of agility, strength and stamina. Participants are advised to jump within their ability – only the individual knows or understands their own limits and competencies. If you are unsure or whether you can complete a manoeuvre, you should not attempt it. If participants have medical concerns, they are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. Due to the physical nature of the Activities, pregnant women must not take part.
Participants need to have good vision and be be able to see similar distances to those required to drive a car in order to be able to complete the activity and to supervise any under 12’s in their care. Consequently, short- or long-sighted participants must ensure that they wear contact lenses or prescribed glasses, unless the Activity prohibits it.
All participants are required to act responsibly and courteously at all times and to respect other participants. Ozone shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behaviour of any participant unsuitable.
Participants must be dressed appropriately and Ozone reserves the right to refuse admittance to the Activities to any participant who is not appropriately dressed and could cause harm to them or another fellow participant.
No refunds or compensation will be payable by Ozone if any participant is not permitted to, or decides not to, undertake or complete the activities for the reasons set out in this clause.
APPROPRIATE CLOTHING
It shall be the responsibility of all participants to ensure that they are dressed appropriately and Ozone advises participants to wear clothing appropriate for physical activity that they do not mind getting damaged and that are in conjunction with our safety video. In particular the following restrictions shall apply:
Participants must wear Ozone trampoline socks for grip and hygiene.
Long hair must always be tied back.
No belts, jewellery, phones or any sharp items of clothing that may cause damage to yourself, the equipment or other participants.
Ozone will not be responsible for any damage to or loss of clothing or other personal items of persons resulting from participation in the Activities.
PRICE AND PAYMENT
Subject to any terms agreed in writing between Ozone and you, our charges for all Activities shall be calculated at our current rates and payment in full shall be due at the time of booking. The charges include the cost of purchasing the Activities. Payment may be made by debit or credit card either online or at the facility.
Ozone reserves the right to change its prices at any time, including special offers. Special Offers are not useable in conjunction with any other offers.
Ozone may operate a peak and off peak charge for walk in customers without prior bookings so please book online before you come avoid this additional fee on open jump tickets.
PARTY BOOKINGS
Party bookings made online or over the phone are to be secured by paying the required deposit upon booking. Failure to make the necessary deposit will mean your spot is NOT secured and can be taken by another with the payment of the deposit.
Customers can change the number of jumpers, plus or minus, (as long as they maintain the minimum of 10 jumpers) up to 7 days before the booking date.
If customers do not bring the full number of jumpers as expected on the day no credit note or refund will be given.
A private party room/area is booked for 30 minute slot following the completion of the jump time. The room/area must be vacated promptly after this time to set up for the next party.
We ask the parent/guardian of the party child stay on site at all times and are responsible for the behaviour of their children. Any behaviour we deem to be unacceptable will be explained to the parent/guardian and your party may come to an end prematurely.
All party food orders must go through the Ozone booking system. With the exception of a special dietary items (pre-arranged as part of the party arrangement), no other food (including birthday cakes and sweets) or drink will be allowed to be brought into Ozone. Only food purchased at Ozone will be allowed to be consumed.
Should any member of the party have any dietary requirements, we will try our best to cater to these needs, please advise us of such requests no later than 7 days prior to the party or group booking.
Should a group or party choose to make amendments to their catering option, a minimum of 7 business days’ notice must be provided.
Additional guests are subject to availability. If Ozone does not have the space, then the request will be declined. We maintain a defined maximum number of participants in the parc and for safety reasons this will not be modified to cater for unbooked guests.
We will supply sufficient cutlery to cut and eat the cake. Any additional decorations you require must be supplied by yourself and must be checked with Ozone in advance. We do not allow decorations to be stuck to the walls. Any decoration brought in with the prior agreement of Ozone must be taken away by you when you leave, or we reserve the right to charge a clean-up and disposal fee.
We are always looking to improve our parks and add new elements. Some of these elements may incur an additional charge and may not be included within your party package.
CANCELLATIONS, REFUNDS AND TRANSFERS
Open Jump All bookings are only eligible to be moved to a new specified date, which the customer can request but will be subject to availability. Under no circumstances
Birthday Parties cancelled by the customer up to 14 days before the booking date will be given a full refund minus an administration fee of 10 euros in addition to any costs already incurred by Ozone. Parties cancelled by the customer fewer than 14 days before the booking date will not be eligible to receive a refund. Where possible, we will endeavour to move your party date and time, subject to availability, or will provide a credit voucher to the value of half any deposit already paid.
Group Bookings – cancelled by the customer up to 14 working days before the booking date will be given a full refund minus an administration fee of 10 euros in addition to any costs already incurred by Ozone. Between 3 to 9 days will receive a 50% refund, minus an administration fee of 10 euros in addition to any costs already incurred by Ozone. Group bookings cancelled fewer than 72 hours days before the booking date will not receive a refund or credit note. Where possible, we will endeavour to move your group booking date and time, subject to availability.
Ozone reserves the right to cancel your booking at any time. In the event that Ozone needs to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. You shall be entitled to a full refund in the event of cancellation under this clause, except whereby the cancellation is covered by lause FORCE MAJEURE. This does not affect any guest’s statutory rights or any liability of Ozone which cannot be excluded by law.
FORCE MAJEURE
No refunds will be possible when circumstances are beyond our control. These include but are not limited to : Fire, Flooding, Lightning or other extreme weather conditions, Explosions, terrorism, war, civil disorder, epidemics, pandemics, government enforced closure or limitations, labour disputes and power cuts. On a case by case basis Ozone will endeavour to offer an alternative if possible or some form and value of credits minus an administration fee of 10 Euro and any costs already incurred by Ozone at the time of the forced cancellation. Ozone will communicate to the customers, where we have a working email address, as soon as is possible with the right information.
COVID19: The COVID pandemic has been declared a state of emergency by the Luxembourg government. In addition the Luxembourg government has enforced a closure of Ozone from 14th March 2020, therefore Ozone cannot maintain any already committed parties/group bookings and jump bookings. For all payments that have already been received from customers that Ozone was forced to cancel the booking due to the pandemic, Ozone has decided to issue a voucher equal to the value already received. This voucher will remain valid for 2 years.
REFUNDS
Payments made by debit or credit card will be refunded to the same card.
No refunds will be given for transactions made by gift vouchers. Bookings may be transferred to a different date where possible.
Where multiple forms of payment are used Ozone reserves the right to refund any monies due on a refund or amendment by debit or credit card.
Refunds to credit or debit cards can take up to 21 working days to process.
CCTV MONITORING & PHOTOGRAPHY
The participant consents and agrees to the use by Ozone of CCTV monitoring for training, insurance, health and safety and security purposes. We do not use any image or video collected without prior agreement from our guests. Ozone consents to the participant and members of their group taking pictures for their own non-commercial purposes only and for no other purpose whatsoever.
MISCELLANEOUS
If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.
Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions.
All promotional vouchers such as free hot/cold drinks or other food and drink refreshments and giveaways such as branded non-slip socks or merchandise are in conjunction with a paid Jump session at Ozone only.
Promotional codes and vouchers are non-transferable and do not have a trade in cash value. Ozone reserves the right to amend or terminate these voucher codes at any time.
LIABILITIES
Except as otherwise provided in these Booking Terms and Conditions, Ozone shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activities. This does not affect any guest’s statutory rights, or any liability held by Ozone which cannot be excluded by law.
Parking facilities are available, and any vehicles and their contents are left at the owners’ risk and are subject to any conditions and the payment of any fees as may be required by the provider (currently Cora) of such facilities at the site location.
Except as otherwise provided in these Booking Terms and Conditions any liability of Ozone shall be limited to the refund of any charges paid by the customer to Ozone, unless and to the extent such a limitation is not permitted by law.
These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of Luxembourg and you submit to the exclusive jurisdiction of the courts of Luxembourg.
